People are losing confidence in the judiciary because of continuing delays in the dispensation of justice and there is a need to create alternate dispute resolution measures to cut the case load in the country’s courts, said Pakistan’s Chief Justice Nazim Hussain Siddiqui. “People are losing confidence in the judiciary and we are responsible for this. The courts are overburdened with a pending backlog of cases. There is a need to develop ways and means for out-of-court settlements that are fair, inexpensive, speedy and accessible,” he said while addressing a national seminar on “Access to Justice and Alternative Dispute Resolution” organised by the Supreme Court Bar Association of Pakistan. Eminent jurists, constitutional experts, incumbent superior court judges, law officers and lawyer’s representatives from across the country attended the day-long seminar and read out their papers. There was agreement among the speakers that a commission should be set up to explore ways to rapidly give justice and clear the backlog of cases. They also demanded that the number of courts and the recruitment of judges be increased and vacant seats in the lower and superior courts be filled. They also demanded the revival of the Conciliation Courts, free legal aid committees and amendment of Arbitration Act. The chief justice said there are several multiple pieces of legislation that provide for alternative dispute resolution methods.
