Subway Contracts Defended In Briefs;

Briefs were filed yesterday with Justice Blackmar in the Brooklyn Supreme Court in the Subway injunction suits. That for the Public Service Commission, which was signed by George S. Coleman, Oliver C. Semple, and Leroy T. Harkness, relied in great part on the decision in the Sun Publishing Company’s case that subways may be fairly built by the city as coming within the statutory meaning of “a city purpose.”

Two agreements made by the New York Edison Company with large consumers were pronounced yesterday by Public Service Commissioner Maltbie to be illegal. No action was taken by the commission on the opinion, but it was decided on Commissioner Maltbie’s recommendation to allow the Edison Company reasonable time to state the course it would pursue in the light of the finding.

Park Board Determines To Begin On The Speedway.

Another important move was made yesterday in reference to the proposed Harlem River driveway. The bids, based upon the specifications calling for one sidewalk only, and that on the inner side of the driveway, were opened at a special meeting of the Park Commissioners, and James D. Leary was found to be the lowest bidder, at $620,916.10.

The American Ice Company, a New Jersey corporation capitalized at $22,500,000, suspended operation in the State of New York yesterday, and all its ice-distributing business here was taken over by the Knickerbocker Ice Company, The President of the old company, Wesley M. Oler, was retained as President of the new corporation. The manufacturing plants of the corporation will have a separate existence under the name of The Ice Manufacturing Company.

Anthracite Officials Had Refused to Present One of the Agreements.

One of the “65-35 per cent.” contracts between the independent operators and the coal companies controlled by the anthracite railroad interests was produced in copy yesterday before the Inter-State Commerce Commission at a session of the hearings on the petition of William R. Hearst. The contract, which was produced by Lawyer Clarence J. Shearn for the petitioner, was admitted as evidence.
